TERMS AND CONDITIONS

1. AGREEMENT TO TERMS

By accessing THE EVERYTHING APP ("Service"), creating an account, or completing any payment through the Service, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions in full. If you do not agree, you must not use the Service. These Terms constitute a legally binding agreement between you and Mr Adam Israel (ABN 76 973 762 662) ("we", "us", "our").

2. SUBSCRIPTION PLANS

We offer the following subscription tiers, billed in Australian Dollars (AUD) via Stripe. By subscribing you also agree to Stripe's terms of service.

Foundation Spark — $1.00 per month (standard rate: $5.00/month). Provides access to core features: weather, watchlist and market data, wealth tracking, and reminders.

Foundation Drive — $5.00 per month (standard rate: $9.99/month). Includes all Foundation Spark features plus rewards tracking, Listonic, and trips.

Foundation Velocity — $55.00 per month (standard rate: $99.00/month). Includes access to all features across the platform.

Investor Support — $5,000.00 upfront, prepaying 12 months of Foundation Velocity access (standard rate: $10,000.00). After the 12-month prepaid period, monthly Foundation Velocity billing commences automatically at the then-current rate. This tier is a prepaid service access arrangement only.

3. BILLING AND RENEWALS

Monthly subscriptions (Foundation Spark, Foundation Drive, Foundation Velocity) renew automatically on your billing date each month. You authorise us to charge your nominated payment method on each renewal. It is your responsibility to maintain a valid payment method. For Investor Support, the full $5,000.00 upfront amount is charged at purchase; automatic monthly billing at the Foundation Velocity rate commences after the 12-month advance period expires.

4. CANCELLATION POLICY

You may cancel your subscription at any time through the Service. Cancellation takes effect at the end of your current billing period — you retain access until that date. No refund, partial or otherwise, is issued for any unused portion of a billing period. For Investor Support, cancellation before the 12-month advance period has elapsed does not entitle you to any refund of the upfront payment, regardless of how much prepaid time remains.

5. NO REFUNDS — ABSOLUTE POLICY

ALL PAYMENTS ARE FINAL AND NON-REFUNDABLE. We reserve the absolute right, at our sole and absolute discretion, to refuse any refund request for any reason or no reason at all. This policy applies without exception to all subscription fees, Investor Support upfront payments, and voluntary contributions (donations). Initiating a chargeback or payment dispute in bad faith may result in immediate suspension or permanent termination of your account.

6. PROMOTIONAL CODES

Promotional or discount codes may be offered at our sole discretion and applied at Stripe checkout where available. Promotional codes are subject to specific conditions, eligibility criteria, and expiry dates. We reserve the right to modify, restrict, or withdraw any promotional code at any time without notice. The use of a promotional code does not alter or waive the no-refund policy.

7. VOLUNTARY CONTRIBUTIONS (DONATIONS)

We accept one-time voluntary contributions of $5.00, $10.00, $25.00, or $50.00 AUD via Stripe checkout. Donations are entirely voluntary and support ongoing platform development and operating costs. All donations are non-refundable under all circumstances. A donation does not grant subscription access, feature entitlements, account credits, or any ownership interest of any kind. A receipt email is issued automatically upon a successful donation.

8. NO OWNERSHIP OR EQUITY ENTITLEMENT

No payment of any kind made through the Service — including subscription fees, Investor Support upfront payments, or voluntary contributions — creates, confers, or implies any ownership interest, equity stake, shareholder rights, governance rights, voting rights, entitlement to profits or dividends, intellectual property rights (beyond the limited licence to use the Service as described), or any other commercial interest in the Service, its operator, or any related entity. The designation "Investor Support" is a service tier label only. It does not constitute or imply any form of investment, partnership, security, or commercial arrangement beyond prepaid access to platform features.

9. ACCEPTABLE USE

You must use the Service lawfully and only for its intended purpose. You must not: access data belonging to other users; reverse-engineer, copy, or decompile the Service; interfere with its security, availability, or integrity; resell or sublicence access to others; or use the Service in any manner that violates applicable laws or regulations.

10. CHANGES TO THE SERVICE AND THESE TERMS

We may update these Terms at any time by publishing a revised version. Continued use of the Service after a version update constitutes acceptance of the updated Terms. We may modify, suspend, or discontinue any feature or aspect of the Service at our discretion and without liability.

11. GOVERNING LAW

These Terms are governed by the laws of the State of Victoria, Australia. Any dispute arising from or in connection with these Terms or the Service is subject to the exclusive jurisdiction of the courts of Victoria, Australia.
